Description of service

A patent is a protective document by which the state grants its owner (i.e. a citizen or entrepreneur) the exclusive right to exploit an invention for a certain period of time. Patents are granted for inventions in all fields of technology that are new, involve inventive activity and are capable of industrial application. New products, devices, technologies, chemically produced substances, pharmaceuticals, industrially produced micro-organisms, biotechnological processes and products obtained by means thereof may be patented. The owner (i.e. a citizen or entrepreneur) of a patent has exclusive rights in relation to the invention protected by the patent, i.e. no one may use it without his consent. A patent is valid for twenty years from the filing of the patent application, with maintenance fees payable to keep the patent valid.

The service allows a citizen or entrepreneur to file a patent application via an electronic form. The electronic general agenda form available on the portal www.slovensko.sk shall be used for communication between the citizen or entrepreneur and the Industrial Property Office of the Slovak Republic (hereinafter referred to as 'the Office') during the prosecution of the patent application up to the issuance of the decision in the prosecution of the patent application (grant of the patent/refusal of the patent application/suspension of the prosecution of the patent application), as well as for the application of ordinary and extraordinary legal remedies.

For whom the service is intended
The service is intended for a citizen or an entrepreneur who is interested in patent protection for an invention.

What is the purpose of the service
The service is used for the filing of a patent application, the subsequent communication of the citizen or entrepreneur with the Office during the pendency of the patent application and the exercise of ordinary and extraordinary remedies.

Method of use of the service
The service shall make an electronic form available to the citizen or entrepreneur in the electronic forms module operated by the Office. After completing the electronic form, the citizen or entrepreneur sends it to his or her electronic mailbox on the Central Portal of Public Administration, from where he or she then makes the actual submission to the Office.
For the communication between the citizen or the entrepreneur and the Office during the patent application procedure up to the decision in the patent application procedure (grant of the patent/refusal of the patent application/suspension of the patent application procedure), as well as for the application of ordinary and extraordinary remedies, it is necessary to use the electronic form of the general agenda, which is available on the portal www.slovensko.sk.

Charging for the service
The filing of a patent application gives rise to a fee. The filing of the electronic general agenda form shall also give rise to a fee if it is a chargeable act under Act No 145/1995 Coll. on Administrative Fees, as amended by the National Assembly of the Slovak Republic. If the fee has not been paid at the time of filing or in the specified amount, it shall be payable within 15 days from the date of receipt of a written request for payment by the Office.
