An application for a retrial or an application for a review of a decision outside the appeal procedure before a public authority, if the latter

1. natural person

2. a legal person or a natural person authorised to do business

Note

The fee paid under this heading shall be refunded if the retrial is granted or if the application for review of the decision outside the appeal procedure is granted in full.

(a) Issue of a specimen copy, extract from registers, files or official documents referred to in this Part of the Tariff, for each page, even for each page commenced

(b) Application to take a professional examination or an aptitude test to practise as a patent attorney

The making of an application in proceedings under this Part of the Tariff for

a) continuation of the proceedings

b) restoration to the previous state

c) the second and any subsequent extension of the time limit

d) the issue of a certificate of priority, for each certificate

a) Filing a patent application

1. the originator or co-originators

2. applicants other than the originator or applicants who are not identical to the co-authors

b) Submission of an application for

1. additional grant of priority

2. additional recognition of a priority document

3. publication of a patent application before the time limit prescribed by law

4. registration in the Register of the transfer or assignment of the rights of a patent application to another applicant or of the transfer or assignment of a patent to another proprietor

5. the registration of another originator, applicant or holder in the Register or the deletion of an originator, applicant or holder from the Register

6. the registration of the licence agreement or the registration of its termination in the register, for each patent application or patent

7. registration of the compulsory licence or registration of its revocation in the register

8. registration of the lien in the register or its deletion from the register, for each patent application or patent

9. the registration of litigation or the registration of its termination in the Register, for each patent application or patent

10. the registration of the execution or the registration of its termination in the register, for each patent application or patent

c) Filing of a request for a complete examination of a patent application

1. up to 10 asserted patent claims

2. for each additional patent claim filed

d) Issue of the patent deed

1. up to 10 typewritten pages or drawings

2. for each additional typewritten page or drawing

e) Filing an application for a supplementary protection certificate

f) Extension of the period of validity of the supplementary protection certificate pursuant to a special provision 47)

g) Filing of a request for modification of the term of validity of the supplementary protection certificate

h) Submission of a request for a search within the priority period

Liberation
Applications pursuant to Act No 92/1991 Coll. on the conditions for the transfer of State property to other persons, as amended, are exempt from the fee pursuant to point (b) of the fourth paragraph of this item.

Notes
1. The Office shall levy a fee under subparagraph (c) of this item at half of the applicable rate where a search report of an international type carried out by the Office as a branch of the Visegrad Patent Institute pursuant to an international treaty has been submitted in the prosecution of the patent application 48) or the search has been carried out within the priority period.
2. The fee referred to in point (d) of this item shall be payable within two months from the date of receipt of the request by the Office.
