Maintenance fees - information for taxpayers

The Industrial Property Office of the Slovak Republic collects maintenance fees according to the Act of the National Council of the Slovak Republic No. 495/2008 Coll. on the fee for maintaining the validity of a patent, on the fee for maintaining the validity of a European patent with effects for the Slovak Republic and on the fee for maintaining the validity of a supplementary protection certificate for pharmaceuticals and plant protection products and on amendment and supplementation of certain acts.

Maintenance fees collected by the Industrial Property Office of the Slovak Republic shall be paid by wire transfer from a bank account or by postal money order.

Maintenance fees shall be paid without notice and shall be payable at the latest on the day on which the previous year of validity expires.

In identifying the payment, the taxpayer shall indicate the variable and specific symbols as indicated below.

Maintenance fees for patents, European patents with effect for the Slovak Republic and supplementary protection certificates shall be paid into a special account of the Industrial Property Office of the Slovak Republic, which shall be kept at:

Variable symbol:

The variable symbol is always made up of a ten-digit numeric code. This code starts from the left with a one-digit prefix X specifying the type of application/request, as follows:

1 PP (patent application)
4 PDO (supplementary protection certificate application)
9 EP (European Patent Maintenance Fees)

The prefix X is followed by the nine-digit application/request number assigned by the Office.

In the case of maintenance fees for patents and supplementary protection certificates (prefixes: 1, 4), the application/request number takes the form:

n5 n4 n3 n2 n1 - YYYYY

where:

n5 n4 n3 n2 n1

- five-digit code for the ascending sequence of numbers of the corresponding application/application (starting from 00000 each year)

YYYY

- four-digit code for the year of submission of the relevant application/request

 

When creating a variable symbol, always base it on the number of the respective application form/application! This means that when creating a variable symbol for national patents and supplementary protection certificates, it is not allowed to base the variable symbol on the number of the granted patent and the number of the granted certificate.

The variable symbol starts from the left with the appropriate prefix X followed by the five-digit code n5 n4 n n n2 n1 for the ascending series of numbers of the corresponding application/request. This five-digit code is followed by the four-digit code YYYY for the year of submission of the corresponding application/request.
Note: For less than five-digit code n5 n4 n3 n2 n1 of the application form/application, zeros are added to the remaining vacant spaces from the left.
(E.g.: the five-digit code 00021 will correspond to 21, the five-digit code 05011 will correspond to 5011.)

In the case of maintenance fees for European patents (prefix 9), the number of the European patent granted takes the form:
EP n7 n6 n5 n4 n3 n2 n1

where: n7 n6 n5 n4 n3 n2 n1 - the seven-digit code for the ascending sequence of European patent numbers granted

The variable symbol starts from the left, in this case with the prefix 9, followed from right to left by the seven-digit code n7 n6 n5 n4 n3 n2 n1 for the ascending sequence of numbers of the European patent granted, and zeros are added in the remaining vacant spaces.
